If you are an individual who is included on the Settlement Class List and your Private Information was potentially compromised as a result of the targeted cyberattack on Valley Oaks Health, Inc.'s (“Valley Oaks”) computer systems that occurred in June 2023 (the "Incident"), you may be a Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (i) the Judge assigned to evaluate the fairness of this Settlement, Court personnel and any members of their immediate families; (ii) Valley Oaks, and any entity in which Valley Oaks Health, Inc. has a controlling interest, is a parent or subsidiary, or which is controlled by Valley Oaks, and the affiliates, legal representatives, attorneys, heirs, predecessors, successors and assigns of Valley Oaks; and (iii) any other person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Incident or who pleads nolo contendere to any such charge.
If you are a Class Member and wish to receive one or more benefits from this Settlement, then you must submit a Claim Form by November 9, 2026.
All Settlement Class Members are eligible to enroll in Medical Monitoring Services and one or more of the cash payment options. These benefits are described in more detail below.
Medical Monitoring Services. All Class Members are eligible to enroll in two (2) years of CyEx Medical Shield Pro. This comprehensive service comes with $1 million of medical identity theft insurance, and includes monitoring for:
healthcare insurance ID exposure
Medical Records Number (MRN) exposure
unauthorized Health Savings Account (HSA) spending
If anything suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.
Reimbursement for Lost Time. Class Members who spent time responding to the Incident may claim up to four (4) hours, at $20.00 per hour, for a maximum of $80.00 (combined with Ordinary Out-of-Pocket Losses, the combined total is capped at $500.00). You must have spent the time on tasks related to the Incident. Some examples include things like:
Ordinary Out-of-Pocket Losses Reimbursement. Class Members who incurred actual, documented out-of- pocket expenses due to the Incident, can get back up to $500.00. The losses must have occurred between June 8, 2023, and November 9, 2026, and you cannot claim a payment for expenses that have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:
fees for credit reports, credit monitoring, or freezing and unfreezing your credit
cost to replace your IDs
postage to contact banks by mail
Extraordinary Out-of-Pocket Losses Reimbursement. Class Members who lost money because of identity theft or fraud, can get back up to $5,000.00. The losses must have occurred between June 8, 2023, and November 9, 2026, and you cannot claim a payment for expenses that have already been reimbursed by a third party. You will need to show that:
the theft or fraud was probably caused by the Incident
the losses are not already covered by Ordinary Out-of-Pocket Expenses
you tried to prevent the loss or get your money back, such as by using insurance you already have
If you claim for either Ordinary Out-of-Pocket Losses and/or Extraordinary Out-of-Pocket Losses, you will need to submit proof, like receipts, to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Incident.
Alternative Cash Payment. Instead of any other payments, Class Members may claim a one-time $40.00 payment.

The deadline to submit a Claim Form online is November 9, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than November 9, 2026.
